These Terms of Service (“Terms”) govern your access to and use of the website at cfmcare.com (the “Site”) operated by Cumming Family Medicine and Dawson 400 Family Medicine (“we,” “us,” or “our”).

By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Important Medical Disclaimer (No Emergency Use)

No medical advice. The Site provides general information about our practice, locations, providers, and services. The Site content is not medical advice and is not a substitute for professional diagnosis or treatment.

No emergencies. Do not use the Site to communicate urgent or emergency medical needs. If you believe you may have a medical emergency, call 911 or go to the nearest emergency facility.

No doctor-patient relationship through the Site alone. Use of the Site does not create a doctor-patient relationship. A doctor-patient relationship is established only through formal registration and a clinical encounter under applicable law.

2. About Our Services

We are a healthcare practice offering primary care/family medicine and related services, which may include same-day sick visits and telemedicine/virtual visits depending on clinical appropriateness and availability. Information on the Site may describe services, but availability may vary by location, clinician schedules, and medical necessity.

3. Appointments, Requests, and Communications

A. Appointment Scheduling

Any appointment request you submit (if available) is not guaranteed until confirmed by our staff.

B. Telemedicine

If you use telemedicine services:

  • You may be required to sign additional consents and comply with additional policies;
  • Telemedicine may not be appropriate for all conditions; and
  • Technical issues (connectivity, device compatibility) may impact service availability.

C. Communication Methods

You agree that we may communicate with you using contact details you provide (or that you otherwise confirm to us), including by phone, voicemail, email, or text message, consistent with law. Standard message and data rates may apply for texts. You may opt out of marketing texts by following instructions in the message (commonly replying “STOP”), subject to legal and clinical communication requirements.

4. Privacy

Your use of the Site is subject to our Privacy Policy, which is incorporated into these Terms by reference. If you are a patient, HIPAA-related practices may apply to PHI as described in our notices and forms.

5. Acceptable Use

You agree not to:

  • Use the Site for unlawful purposes;

  • Interfere with the Site’s operation or security;
  • Introduce malware or harmful code;

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE.

IN ANY EVENT, TO THE EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED $100 OR THE AMOUNT YOU PAID TO USE THE SITE (IF ANY), WHICHEVER IS GREATER.

12. Governing Law and Venue

These Terms are governed by the laws of the State of Georgia, without regard to conflict of laws rules. Unless prohibited by law, you agree that any dispute arising out of or relating to these Terms or the Site will be brought in the state or federal courts located in Forsyth County, Georgia, and you consent to personal jurisdiction there.

We may update these Terms from time to time. The Last Updated date indicates when changes were made. Your continued use of the Site after changes become effective means you accept the updated Terms.
